Who we are

Gosellcar is an intermediary online marketplace for buying and selling used cars. Our goal is to provide higher level of transparency, speed, reliability and price competitiveness by advertising customer cars with a list price through a public ad.

Registration is easy and can be done at the comfort of their homes. Any prospective seller upon accessing and registering with Gosellcar may immediately enlist his/her cars/vehicles intended to be sold and upload the proprietary documents, car pictures and videos to our website. Buyer’s are able to contact with seller through chat and later buyer and seller can exchange phone contacts and later they can communicate directly. When a vehicle is sold from seller to buyer, both parties can rate each other and leave feedback that will become part of the user profile reputation.

Accounts & Membership

You must be at least 18 years of age to use the Services. By using the Services and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age. If you create an account on the Services, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may monitor and review new accounts before you may sign in and start using the Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

Pricing

You can place an ad for as little as 10 AED for Standard Ad. You can boost your ad with 35 AED for Featured Ad. We also provide monthly subscriptions starting at 5000 AED Dealer Ads that allow unlimited ads.

Subscriptions

We provide a wide ranage of subscriptions for dealerships. We have plans for one, three, six, twelve and tweenty four months. For the terms and conditions check seperate T&C.

Refunds

In the instance where any monies paid by any purchaser should be deemed as refundable, all sums agreed by the company shall be returned in the format of the payment made by the purchaser. In the instance of credit or debit card payments, all returns shall be paid back via the credit / debit card supplier less any fees due in respect of the return payments. Agreed refunds shall be made within 10 working days of the companies agreement to refund such sums.

Intellectual Property Rights

The Gosellcar website has exclusive propriety in all of its contents and protected under the intellectual property laws of the United Arab Emirates and international law. Unauthorised publication, transmission or the use of of its content without proper permission shall be subject to applicable penalties provided by prevailing Intellectual Property laws.

Indemnity

You agree to indemnify, and hold Us and our officers, directors, agents, employees, contractors and suppliers, harmless from any claims or demands, including reasonable attorneys’ fees, made by any third party, including but not limited to

1. any actions or activities of our active and prospective buyers pertaining to you (the seller/car owner) through our website.
2. your violation of these Terms or your use of the Site in violation of these Terms, or in violation of any applicable law. You further agree that you will cooperate fully in the defence of any such claims. We reserve the right, but not the obligation, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any such claim or matter without the written consent from Us. You further agree to indemnify and hold Us harmless from any claim arising from a third party's use of information or materials of any kind that you submit to the Site.

Backups

We perform regular backups of the Website and its Content and will do our best to ensure completeness and accuracy of these backups. In the event of the hardware failure or data loss we will restore backups automatically to minimise the impact and downtime.

Links to the other Resources

Although the Services may link to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. Some of the links on the Services may be "affiliate links". This means if you click on the link and purchase an item, Gosellcar will receive an affiliate commission. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Services. Your linking to any other off-site resources is at your own risk.

Prior Express Notification

By using our website, you agree that you will notify Gosellcar in writing about any claims, complaints and dispute arising from the use of our website and you are providing us a reasonable period to rectify any issues at hand before proceeding with any legal action.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Gosellcar , its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Gosellcar and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to Gosellcar for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

Governing Laws and Jurisdiction

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of United Arab Emirates without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of United Arab Emirates. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in United Arab Emirates, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Effectivity and The Right to Change or Amend

Gosellcar reserves the right to alter, delete, amend or change the above terms and conditions or any policies or policies governing the use of this website and the availment of this Site anytime or in our discretion without prior notice.Any changes will be effective upon the posting of the changes to the Site. You are responsible for periodically reviewing the changes. Your continued use of this Site and the Services following the posting of any changes will constitute your acceptance of such changes or modifications. If you do not agree to any changes to these Terms, do not continue to use the Services or this Site.

Acceptance of these Terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Services you agree to be bound by this Agreement.
